Agreement to Our Legal Terms

These Terms & Conditions (“Terms”) are a legal agreement between Selam Atobirhan d/b/a Hartca (“Hartca,” “we,” “us,” “our”) and you (“you”). They govern your access to and use of hartca.com and any related services, features, or content that link to these Terms (collectively, the “Services”).
By visiting or using the Services, you confirm that you’ve read, understood, and agree to be bound by these Terms. If you do not agree, do not use the Services.

We may update these Terms from time to time. When we do, we’ll revise the “Last Updated” date above. Your continued use of the Services after updates means you accept the revised Terms. We recommend printing a copy for your records.

1) Our Services

The Services are intended for use in jurisdictions where access and use are lawful. If you access the Services from outside such jurisdictions, you do so on your own initiative and are responsible for compliance with local laws.


2) Intellectual Property Rights

All content within the Services—including text, graphics, photos, logos, icons, audio, video, code, databases, and design (collectively, “Content”)—and all trademarks, service marks, and logos (the “Marks”) are owned by or licensed to Hartca and are protected by applicable intellectual property and unfair competition laws. The Content and Marks are provided “AS IS” for your personal, non-commercial use or internal business purpose only.


3) Your License to Use the Services

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access the Services and download/print portions of the Content you properly access for personal, non-commercial use or internal business purposes.
No other rights are granted. You may not copy, reproduce, aggregate, republish, upload, post, publicly display, encode, translate, transmit, distribute, sell, license, or otherwise exploit any part of the Services, Content, or Marks without our prior written permission.


4) User Representations

By using the Services, you represent and warrant that:

  • You have legal capacity and agree to these Terms;
  • You are not a minor in your jurisdiction;
  • You will not access the Services through automated or non-human means (bots, scripts, etc.);
  • You will not use the Services for any illegal or unauthorized purpose; and
  • Your use complies with all applicable laws and regulations.

We may suspend or terminate access if information you provide is inaccurate, not current, or incomplete.


5) Prohibited Activities

You agree not to:

  • Systematically retrieve data or Content to create a database or directory without written consent;
  • Circumvent, disable, or interfere with security features;
  • Misuse support channels or submit false abuse reports;
  • Upload viruses, malware, or spam, or otherwise disrupt the Services;
  • Use any scraping, harvesting, or automated tools without authorization;
  • Infringe IP rights or remove proprietary notices;
  • Impersonate another person or misrepresent your affiliation;
  • Use the Services in any manner that violates law or these Terms.

6) Submissions & Feedback

If you send us questions, ideas, or feedback (“Submissions”), you grant Hartca a worldwide, perpetual, irrevocable, royalty-free license to use, reproduce, modify, publish, and distribute such Submissions for any lawful purpose without compensation or attribution. You represent that you have rights to grant this license and that Submissions do not contain confidential information.


7) User-Generated Content & License

If the Services allow posting or sharing content (“Contributions”), you retain ownership of your Contributions. By posting, you grant Hartca a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and distribute your Contributions as necessary to operate the Services. You are solely responsible for your Contributions and agree they will not be unlawful, infringing, defamatory, obscene, or otherwise prohibited by these Terms.


8) Services Management

We may, but are not obligated to, monitor the Services for compliance with these Terms; take legal action for violations; remove content that is excessive or burdensome; and manage the Services to protect our rights and ensure proper operation.


9) Term & Termination

These Terms remain in effect while you use the Services. We may, at our sole discretion, deny access to anyone for any reason (including IP blocking), without notice or liability, and may delete any content you post. If terminated, you may not register a new account under your name or any third party’s name.


10) Modifications & Interruptions

We may change or remove portions of the Services at any time without notice. We do not guarantee continuous availability and are not liable for interruptions, delays, errors, or required maintenance downtime.


11) Pricing, Orders & Availability

Prices, descriptions, and availability of products are subject to change without notice. We reserve the right to refuse or cancel any order for reasons including suspected fraud, errors in pricing or description, or violations of these Terms. If we cancel an order after your payment is processed, we will issue a refund to your original payment method.


12) Shipping, Returns & Refunds (Summary)

  • Shipping: As stated on our Shipping Policy (updated October 1, 2025). Processing is on business days Monday–Friday (EST); cut-off 5:00 PM EST; continental U.S. only (no APO/FPO, AK/HI/PR/Guam/USVI or international).
  • Returns: As stated on our Return Policy (updated October 1, 2025). Eligible returns within 180 days of delivery; items must be new, unwashed, unworn, with tags and receipt. Return Cost: $0.00 for approved returns per that policy.
  • Refunds: As stated on our Refund Policy (updated October 1, 2025). 24-hour cancellation window; eligibility criteria and timelines apply.

13) Disclaimers

THE SERVICES AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE; THAT DEFECTS WILL BE CORRECTED; OR THAT ANY CONTENT IS ACCURATE, COMPLETE, OR CURRENT.


14) Limitations of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL HARTCA OR ITS OFFICERS, EMPLOYEES, AGENTS, OR SUPPLIERS BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES (INCLUDING LOST PROFITS, LOST REVENUE, LOSS OF DATA, OR BUSINESS INTERRUPTION), EVEN IF ADVISED OF THE POSSIBILITY.
OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID TO HARTCA IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM OR USD $100, WHICHEVER IS GREATER. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; SOME LIMITATIONS MAY NOT APPLY TO YOU.


15) Indemnification

You agree to defend, indemnify, and hold harmless Hartca and our affiliates, officers, agents, partners, and employees from any claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Services; (b) your breach of these Terms; (c) infringement or violation of any third-party right by you or your Contributions; or (d) any harmful act toward another user with whom you connected via the Services.


16) Privacy & Cookies

Your use of the Services is also governed by our Privacy Notice (if posted) and Cookie Policy (Last Updated: October 1, 2025). The Cookie Policy explains how we use cookies/trackers and how you can control them.


17) Electronic Communications, Transactions & Signatures

By using the Services, you consent to receive electronic communications from us. You agree that all agreements, notices, disclosures, and other communications we provide electronically satisfy any legal requirement that such communications be in writing. You consent to the use of electronic signatures and records for transactions initiated or completed via the Services.


18) Governing Law & Dispute Resolution

Governing Law & Venue. These Terms are governed by the laws of the State of California, without regard to conflicts of law rules. The exclusive forum and venue for any action arising out of or relating to these Terms or the Services will be the state and federal courts located in Santa Clara County, California, and you consent to personal jurisdiction there.

Informal Resolution First. Before filing any claim, the parties will attempt to resolve disputes informally for at least 30 days after written notice of the dispute is sent to the addresses in the Contact Us section.

No Class Actions. To the extent permitted by law, disputes will be conducted only on an individual basis—no class, consolidated, or representative actions.

(If you prefer binding arbitration language instead of court venue, tell us and we’ll supply an AAA/JAMS clause tailored to your preferences.)


19) Miscellaneous

These Terms, together with any policies posted on the Site (including Shipping, Return, Refund, and Cookie policies), constitute the entire agreement between you and Hartca regarding the Services. If any provision is held unlawful or unenforceable, that provision will be severed and the remaining provisions will remain in full force. Our failure to enforce any right is not a waiver. We may assign our rights and obligations at any time. No agency, partnership, joint venture, or employment is created by these Terms.
