This policy explains our approach to intellectual property, how you may report suspected infringement, and how we will respond.
1. Respect for Intellectual Property
- All trademarks, logos, designs, text, photographs, product images, graphics, and content appearing on hartca.com are the property of Selam Atobirhan (Hartca) or third-party rights holders.
- These works are protected by U.S. copyright, trademark, and other intellectual property laws.
- Nothing on our Website grants any license or right to use such marks or content without prior written permission.
- Users, visitors, or third parties must not upload, post, list, or distribute any material that infringes upon the intellectual property rights of others.
2. Prohibited Infringement
- Hartca strictly prohibits the unauthorized use of another party’s copyrights, trademarks, patents, trade secrets, or other proprietary rights.
- Any listing, image, or material found to violate IP rights will be reviewed and may be removed immediately.
- Repeat or intentional infringers may be subject to account termination or refusal of further services.
3. Reporting IP Infringements (DMCA Takedown)
If you believe that any content, product, or material on our Website infringes upon your intellectual property, please submit a written notice to us with the subject line: “IP Infringement Notice”.
Your notice must include the following (in compliance with the Digital Millennium Copyright Act (DMCA) for copyright complaints):
- Identification of the copyrighted work or trademark claimed to have been infringed.
- Identification of the infringing material (including the exact URL or product name on hartca.com).
- Your full name, mailing address, telephone number, and email address.
- A statement that you have a good-faith belief that the disputed use is not authorized by the IP owner, its agent, or the law.
- A statement, under penalty of perjury, that the information in your notice is accurate and that you are authorized to act on behalf of the IP owner.
- Your physical or electronic signature.
4. Investigation and Response
- Upon receipt of a valid infringement notice, Hartca will promptly investigate and, if necessary, remove or disable access to the allegedly infringing material.
- If applicable, the individual or party who provided the material may be notified and may have the opportunity to submit a counter-notice if they believe the removal was made in error, in accordance with the DMCA.
- Hartca will act in good faith and in compliance with all applicable laws during this process.
5. Repeat Infringers
If a user, seller, or partner is found to repeatedly infringe intellectual property rights, Hartca reserves the right to:
- Terminate accounts,
- Deny access to future services, and/or
- Take further legal action where appropriate.
6. False Claims Warning
Please note: Submitting false claims of infringement may itself be unlawful and could result in legal liability for damages, including costs and attorney’s fees. We urge rights holders to submit infringement notices in good faith only.
